Broker Code Overhaul Puts Renewals and Disclosure in Focus

The 2027 code starts on 1 January with staged obligations for subscribing insurance brokers

A new Insurance Brokers Code of Practice has been launched by the National Insurance Brokers Association, putting clearer disclosure, renewal contact and client support standards on the agenda for Australian businesses that use brokers to arrange cover.
The 2027 Code takes effect on 1 January 2027 and is designed to set out, in plainer language, what clients should be able to expect from subscribing insurance brokers.

For small and medium business owners, the most practical change is not a promise of cheaper premiums or broader cover. It is a stronger framework for conversations that often happen under pressure: renewal time, a large premium movement, a disputed claim, or a major event such as a flood, fire or storm. The Code says clients can ask what their broker is paid and receive the answer in dollars. It also doubles the minimum pre-renewal contact period from 14 days to 28 days, giving businesses more time to question limits, exclusions, deductibles, sums insured and alternative approaches.

The change matters because many firms rely on an insurance broker to help navigate complex policy wording across public liability, professional indemnity, property, management liability, cyber and business interruption cover. A better documented renewal conversation may reduce the risk of assumptions going untested, especially where a business has changed premises, added staff, taken on new contracts, introduced online sales, or bought new equipment.

The Code also includes a separate conflicts of interest section and a new section on client records. For clients experiencing vulnerability, it introduces a process where, with consent, relevant circumstances can be recorded so they do not need to be repeatedly explained. After a declared catastrophe, brokers are expected to contact affected clients as soon as reasonably possible and offer claims assistance.

There are limits to what the change can achieve. The Code applies to subscribers, not every participant in the market. It does not rewrite policy terms, remove exclusions or replace Australian financial services law. NIBA has also allowed up to 12 months for obligations requiring new systems, processes or training to be fully met, so business owners should not assume every operational change will appear immediately on 1 January.

At renewal, businesses may wish to prepare a short checklist before speaking with their broker:

  • what has changed in the business since the last renewal;
  • which policy limits, sub-limits and exclusions are most important;
  • how the broker is paid and whether any conflicts may arise;
  • what claims support is provided if an incident occurs;
  • what records will be kept of advice, instructions and decisions.

The broader message is that transparency is becoming a more visible part of business insurance, not an optional courtesy. For SMEs facing premium pressure and more complex risks, the quality of the renewal discussion may be just as important as the final premium figure.
